Custodies and their division

Custody – once it begins and once it ends. Each custody has its own time limit. It is about the complexity of the case, i.e. the complexity of the paragraphs and the length of the sentence (we will provide an expert explanation according to the individual questions to the paragraphs).

“A” ESCAPE CUSTODY  (MEDIUM CUSTODY)

You are locked in a cell for 24 hours, of which you have a right for 1-2 hour walk in a closed small space (so-called prison yards)

– it is usually imposed for fear that the prisoner would escape, hide and avoid prosecution. For fear of heavy punishment or repeated “escape” behaviour in the past.
– you can receive mail without checking (by the police force and law enforcement agencies), it is checked by your clerk already at the institute.
– you can freely call 5 telephone numbers, which you enter in the form and the clerk will upload them to the system. Phone calls are being recorded. Call time is 120 minutes a day. The minute of the call is 0.19 Euro/minute to the mobile network, 0.10 Euro to the landline.
– you are entitled to a visit every month, which you request at the institute. By law, they should allow it.
– you are entitled to a contact visit every three months, which means that you can have a visit, sit at one table without being separated by glass.

The visit lasts 2 hours, a maximum of 5 people can come to visit together, if the accused has more than 4 minor children, this restriction does not apply to the children of the accused.


“B” COLLUSIVE CUSTODY
(THE MOST DIFFICULT CUSTODY for the psyche OF THE PERSON IN THE INSTITUTION AND HIS FAMILY OUTSIDE)

The fear of influencing witnesses, experts, victims, etc. resulted in the institute of so-called collusive custody. You are locked in a cell for 24 hours, of which you have a right for 1-2 hour walk in a closed small space (so-called prison yard). Your correspondence, both outgoing and incoming, is subject to scrutiny – it is carried out by law enforcement / your investigator, who reads every single letter.

It takes 1-2 months for each letter to reach the addressee, as law enforcement agencies usually perform this activity once a month. You may give phone numbers for approval to law enforcement agencies, but they usually do not approve to call on them, because you are in a collusive custody (to prevent witnesses from being influenced). You may be also allowed to make 20-minute phone calls twice or four times a month, but only under the supervision of law enforcement authorities, which means that you will inform your family through a lawyer that you want to call them, then a police officer comes, stands by you in the hallway and listens every word you say.

For visits, you can name a maximum of 5 people, which you must write on a request for visits that go to the approval of law enforcement authorities – i.e. your investigator – who may remove certain persons from the list, the visit may be authorized without control by law enforcement authorities or under the supervision of law enforcement authorities. This means that law enforcement agencies are still present when you communicate with someone you are visiting. The visit lasts 2 hours, a maximum of 5 people can come to visit together, if the accused has more than 4 minor children, this restriction does not apply to the children of the accused.


“C” CONTINUED CUSTODY
(THE LIGHTEST IMPACT for the psyche)

You are in “open” mode, which means freer movement in the hallway, greater access to contact with people in the hallway – in the section.

– it is imposed for fear of continuing the crime.
– you can receive mail without scrutiny (by police force and law enforcement agencies), it is checked by your clerk at your institution.
– you can freely call 5 telephone numbers, which you enter in the form and the clerk will upload them to the system. Phone calls are being recorded. Call time is 120 minutes a day. The minute of the call is 0.19 Euro/minute to the mobile network, 0.10 Euro to the landline.
